Overview
We have made a direct award to the provider of Digital XP technology in which a technologyduopoly exists between Liferay and Aquia. We have appraised both technologies during a 'play day' and Liferay has emerged the only technology capable of meeting the Council's technical requirements. The solution provided by Liferay is a 'core requirement' of the Council's new digital platform. This question was considered in the case of Commission v Italy Case 199/85, where the ECJ confirmed that it was insufficient to demonstrate that a particular provider was able to produce the most efficient performance;it was required to show that only that provider could produce what was required.
